Terms & Conditions for Entrepreneur

Operated By: SUN CONSULTATION (“we,” “our,” “us”), the creator and owner of 3pmCIRCLE.

By enrolling in a 3pmCIRCLE membership plan (Basic or Premium), you (“Entrepreneur,” “Member,” “You”) agree to the following terms and conditions. Please read them carefully before purchasing a membership.

1. Membership Benefits

As a Basic member of 3pmCIRCLE, you may avail:

  • Access to Scout Classical or Proprietary Medicine opportunities for Private Labelling.
  • Access to Scout Manufacturing Companies in the Ayurvedic Industry.
  • Sample Procurement at Free or at the rate offered by the manufacturer before finalising bulk-scale orders.

As a Premium member of 3pmCIRCLE, you may avail:

  • One Year Paid Membership from the date of approval or as offered by management.
  • All Free Plan benefits +
  • Communicate with manufacturers through experienced mediation.
  • Product Agreement & Lesioning Support with manufacturers.
  • Process Coordination between the entrepreneur and manufacturer.
  • Escrow Service to ensure transaction safety.
  • Exclusive Discounts on other consultation services offered by SUN CONSULTATION.

2. Membership Terms

  • Membership is non-refundable, non-transferable, and valid for one month only.
  • Renewal is at the discretion of the Entrepreneur and must be done before expiry to avoid service interruption.
  • Membership fees are subject to revision at the sole discretion of SUN CONSULTATION.

3. Responsibilities of Members

  • Members are solely responsible for:
    • Accuracy of information shared with manufacturers and within 3pmCIRCLE.
    • Compliance with applicable laws, regulations, and licensing requirements for their business.
    • Execution of any agreements, contracts, or financial transactions with third parties.
  • Members shall not misuse the messaging or networking facilities for spamming, fraudulent activity, or unauthorised promotions.
  • Any violation may result in immediate suspension or termination of membership without refund.

4. Platform Service Charges

  • For services under Premium Membership, such as:
    • Product Agreement & Lesioning Support with Manufacturers
    • Process Coordination between Entrepreneur and Manufacturer
    • Escrow Service for safe transaction
  • The Entrepreneur agrees to bear all additional expenditures related to the project. All expenditures must be paid in advance before initiation of the fulfilment process.
  • The Entrepreneur shall be liable to pay Platform Service Charges at the rate of 2% of the total order value, in addition to the membership fee if proceeding for coordination & escrow facility.
  • These charges are mandatory, non-refundable, and shall be payable at the time of availing the service or upon finalisation of the transaction, as may be applicable.
  • SUN CONSULTATION reserves the right to revise the rate of Platform Service Charges with prior notification, and such revisions shall apply prospectively.

5. Role of SUN CONSULTATION & 3pmCIRCLE

  • SUN CONSULTATION is a facilitator only and does not act as a manufacturer, distributor, or guarantor of any product.
  • We provide access, guidance, and coordination support, but are not liable for product quality, regulatory approvals, financial disputes, or delivery commitments between Entrepreneurs and Manufacturers.
  • The Escrow Service (for premium members) is designed to provide transaction safety, but SUN CONSULTATION is not liable for disputes beyond escrow scope once funds are released.
  • All intellectual property, content, and materials available on 3pmCIRCLE remain the exclusive property of SUN CONSULTATION.

6. Limitation of Liability

  • SUN CONSULTATION and 3pmCIRCLE shall not be responsible for losses, damages, delays, or disputes arising out of business dealings between Entrepreneurs and Manufacturers.
  • Our liability (if any) shall be limited strictly to the amount of membership fees paid for the current cycle.
  • Members agree to indemnify and hold harmless SUN CONSULTATION from any third-party claims, liabilities, or disputes arising from their business activities.

7. Product Return & Refund Policy

  • 3pmCIRCLE is a facilitation platform and not the manufacturer or seller of any product. Therefore, it does not provide direct guarantees, warranties, or commitments on product quality, packaging, or standards.
  • In cases where an Entrepreneur receives products that are:
    • Damaged during transit, or
    • Not as per the agreed specifications/standards,
    • The Entrepreneur must raise the issue within 7 working days of receiving the product.
  • All return and refund claims shall be handled directly between the Entrepreneur and the Manufacturer. 3pmCIRCLE may assist in liaisoning and communication, but shall not be held liable for refunds, replacements, or financial losses.
  • If the transaction was facilitated through the Escrow Service, refund/return handling shall be subject to the specific Escrow Terms, where funds may be withheld or refunded based on mutually agreed resolutions between the parties.
  • Entrepreneurs acknowledge and agree that SUN CONSULTATION/3pmCIRCLE shall not be liable for:
    • Product defects,
    • Quality mismatches, or
    • Any consequential damages or losses.

8. Confidentiality & Data Use

  • Members agree not to misuse or share confidential data, manufacturer contacts, or platform resources outside 3pmCIRCLE.
  • SUN CONSULTATION reserves the right to use aggregated, non-identifiable membership data for research, improvement, or promotional purposes.

9. Termination

  • SUN CONSULTATION reserves the right to suspend or terminate any membership if the Member engages in:
    • Misrepresentation or fraudulent activities.
    • Violation of laws or ethical business conduct.
    • Breach of these Terms & Conditions.
  • No refunds shall be provided in case of termination due to member misconduct.

10. Governing Law

  • These Terms & Conditions shall be governed by the laws of India.
  • Any disputes shall be subject to the jurisdiction of the courts in Jamnagar, Gujarat, India.

11. Modification of Terms

  • SUN CONSULTATION reserves the right to amend, update, or discontinue any part of 3pmCIRCLE services and these Terms & Conditions at any time without prior notice.
  • Continued use of the platform constitutes acceptance of such changes.

12. Additional Entrepreneur Obligations

In addition to responsibilities already outlined, every Entrepreneur agrees that:

  • They shall inspect samples or product specifications before finalising purchase agreements with manufacturers.
  • They are responsible for complying with local regulatory approvals, licenses, and labelling requirements before selling or distributing the products sourced through 3pmCIRCLE.
  • They will not hold SUN CONSULTATION or 3pmCIRCLE liable for product-related disputes, consumer complaints, or regulatory actions that may arise from their business activities.
