Terms & Conditions for Ayurvedic Manufacturers

Operated By: SUN CONSULTATION (“we,” “our,” “us”), the creator and owner of 3pmCIRCLE.
These Terms & Conditions (“T&C”) govern the participation of Ayurvedic Manufacturers (“Member”/“You”) in the 3pmCIRCLE membership program operated by SUN Consultation (“We”/“Us”/“Our”). By registering as a member, you agree to comply with and be legally bound by the following terms.
1. Membership Benefits
As a Basic member of 3pmCIRCLE, you may avail:

  • Offer & Trade Bulk Supply to practitioners
  • Option to get paid on Product Sampling Campaigns or promote samples free of cost.
  • Unlimited & Free Listing of Classical Medicines.
  • Proprietary Product Listing: 5 Products Free
  • Get product review from practitioners
  • Secure payments until delivery is confirmed through the Escrow Facility

As a Premium member of 3pmCIRCLE, you may avail:

  • One Year Paid Membership from the date of approval or as offered by management.
  • All benefits of Basic Membership plus.
  • Unlimited showcase of Evidence-based Proprietary Products.
  • Coordination assistance with Entrepreneurs for private labelling projects.
  • Third Party Agreement business facilitation on a requirement basis.
  • Project opportunities for Custom Formulation.
  • Cross-branding & Digital Promotion campaigns.
  • Project Agreement & Lesioning Support with buyers.
  • Process Coordination between stakeholders.
  • Opportunity to promote proprietary products through Sampling Campaigns.

2. Membership Eligibility

  • Member must be a registered Ayurvedic manufacturer holding valid AYUSH manufacturing licenses as per local regulations.
  • Only after verification manufacturer can avail the excess of the portal.
  • All products listed must comply with the Drugs & Cosmetics Act (India) and applicable AYUSH guidelines.
  • Evidence-based products must be supported with proper documentation, research references, or clinical validation.

3. Responsibilities of Members

  • Members shall provide accurate and authentic information about their company and products.
  • Members are solely responsible for regulatory compliance, safety, efficacy, and legal validity of their products.
  • Any false claims, misleading promotions, or non-compliance may lead to suspension or termination of membership without refund.
  • Members agree not to misuse the Message feature for spamming, misleading, or irrelevant communication.

4. Product Agreement, Liaisoning & Escrow Services

  • Product Agreement & Liaisoning Support: 3pmCIRCLE will facilitate process coordination between entrepreneurs and manufacturers for custom requirements, third-party manufacturing, or bulk supply.
  • Escrow Service:
  • Payments for confirmed orders will be routed through 3pmCIRCLE’s escrow mechanism to ensure transparency and trust between buyer and manufacturer.
  • Funds will be released to the manufacturer upon confirmation of order fulfilment by the buyer/entrepreneur/medicinal practitioner.
  • Platform Service Charges:
  • Manufacturers agree to pay applicable platform service charges for Product Agreement, Liaisoning, Escrow, or other facilitation services.
  • Charges will be notified in advance and deducted before disbursement from the escrow account.
  • Charge: 10% of order value will be deducted for all services.
  • Bulk Orders by Practitioners: When Ayurvedic practitioners place bulk product orders, the same escrow and service charge process will apply.

5. Payment & Renewal

  • Basic Membership is free.
  • Premium Membership requires payment of ₹10,000/- per year (non-refundable).
  • Renewal reminders will be provided 30 days before expiry.
  • Non-renewal will automatically downgrade membership to Basic.

6. Limitations of Liability

  • 3pmCIRCLE acts as a business facilitation platform and does not guarantee sales or commercial success.
  • We do not endorse or verify the therapeutic claims of listed products.
  • Any business transaction or agreement between a manufacturer and a buyer/entrepreneur is at their own risk.
  • We shall not be liable for disputes arising out of product quality, delivery, payments, or regulatory actions.

7. Termination & Suspension

  • Membership may be terminated or suspended if a member:
  • Violates these T&C.
  • Provides misleading or false product information.
  • Fails to comply with AYUSH/Drug & Cosmetics Act or any applicable regulation.
  • Engages in unfair trade practices.
  • No refund will be issued upon termination of Premium Membership.

8. Distribution Port

  • The manufacturer is willing to transport their goods from their stockiest then only one distribution network is allowed and can add all business details. All the transactions and billing for transport will be considered from that end only.

9. Amendments

  • We (SUN CONSULTATION/3pmCIRCLE) reserve the right to amend or modify these Terms & Conditions, membership structure, or benefits at any time.
  • Members will be notified via email/portal updates. Continued participation implies acceptance of revised terms.

10. Return & Refund Policy (Damaged / Non-Standard Products)

  • Buyer Rights: If a client (entrepreneur or practitioner) receives products that are damaged, defective, expired, or not meeting agreed standards/quality specifications, the client has the right to request a return and refund through the 3pmCIRCLE platform within 7 business days of delivery.
  • Manufacturer Obligations:
    • The manufacturer is responsible for arranging the return pickup (or accepting return delivery).
    • The manufacturer must either:
    • Replace the returned product with the correct/standard product, OR
    • Refund the full order value (excluding applicable service charges) through the escrow system.
    • The refund or replacement must be initiated within 10 business days of approval.
  • 3pmCIRCLE’s Role:
    • Acts as a mediator between the client and the manufacturer.
    • Holds the payment in escrow until the issue is resolved.
    • Refunds are released to the client only after return confirmation.
    • Releases payment to the manufacturer only after the client confirms satisfactory replacement or resolution.
  • Service Charges:
    • Platform service charges are non-refundable under all circumstances.
    • The manufacturer bears responsibility for losses arising from product non-compliance, defects, or damages.
    • The manufacturer shall be liable to pay Platform Service Charges at the rate of 10% of the total order value for bulk orders and for third-party projects, 10% of the order value for coordination, in addition to the membership fee.
  • Dispute Escalation:
    • If there is disagreement, both parties must submit supporting documents (photographs, invoices, lab reports, if applicable).
    • 3pmCIRCLE will attempt fair mediation. If unresolved, the case will be escalated to arbitration/legal process as per Indian law.

11. Digital Promotion & Branding (Premium Members)

  • Cross-branding and digital promotions will be carried out as per 3pmCIRCLE’s internal campaign strategy.
  • 3pmCIRCLE reserves the right to decide placement, visibility, and format of promotions.

12. Governing Law

  • These Terms & Conditions shall be governed by and construed in accordance with the laws of India.
  • Any disputes shall be subject to the jurisdiction of the courts in Jamnagar, Gujarat.

13. Modification of Terms

  • SUN CONSULTATION reserves the right to amend, update, or discontinue any part of 3pmCIRCLE services and these Terms & Conditions at any time without prior notice.
  • Continued use of the platform constitutes acceptance of such changes.
