Terms & Conditions of Ayurvedic Marketer

Operated By: SUN CONSULTATION (“we,” “our,” “us”), the creator and owner of 3pmCIRCLE.

These Terms & Conditions (“Terms”) govern your membership and participation as an Ayurvedic Marketer on 3pmCIRCLE, a B2B platform owned and operated by SUN CONSULTATION. By registering as a member, you agree to abide by these Terms.

1. Membership Benefits

As a Basic member of 3pmCIRCLE, you may avail:

  • Offer & Trade Bulk Supply to practitioners
  • Unlimited & Free Listing of Classical Medicines.
  • Showcase your first Evidence-based Proprietary Product at ₹800/- per product per year.
  • Get product review from practitioners
  • Option to get paid on Product Sampling Campaigns or promote samples free of cost.
  • Escrow Service provided by 3pmCIRCLE to ensure transaction safety.

As a Premium member of 3pmCIRCLE, you may avail:

  • One Year Paid Membership from the date of approval or as offered by management.
  • All benefits of Basic Membership plus.
  • Showcase Unlimited Evidence-based Proprietary Products.
  • Opportunity to promote proprietary products through Sampling Campaigns.
  • Cross Branding & Digital Promotion supported by 3pmCIRCLE.

2. Membership Eligibility

  • Member must be a registered MSME & FSSAI as per regulations. Must have a GST license.
  • Only after verification marketer can avail the excess of the portal.
  • All products listed must comply with the Drugs & Cosmetics Act (India) and applicable AYUSH OR FSSAI guidelines.
  • Evidence-based products must be supported with proper documentation, research references, or clinical validation.
  • All members must provide authentic documentation when requested. False or misleading claims may lead to suspension or termination of membership.
  • FSSAI manufacturers can only have access to third-party projects on an interest basis. 

3. Responsibilities of Members

  • Members shall provide accurate and authentic information about their company and products.
  • Members are solely responsible for regulatory compliance, safety, efficacy, and legal validity of their products.
  • Any false claims, misleading promotions, or non-compliance may lead to suspension or termination of membership without refund.
  • Members agree not to misuse the Message feature for spamming, misleading, or irrelevant communication.

4. Product Listing & Promotion

  • Marketers are responsible for ensuring all listed products comply with AYUSH or FSSAI regulations, labelling requirements, and quality standards.
  • Evidence-based claims must be supported with proper documentation and may be subject to verification.
  • Any misleading claims, adulteration, or non-compliance may result in suspension of membership without refund.

5. Escrow & Transactions

  • 3pmCIRCLE acts as a neutral intermediary to ensure safe payments but is not liable for product quality or delivery failures by marketers.
  • Payments for confirmed orders will be routed through 3pmCIRCLE’s escrow mechanism to ensure transparency and trust between buyer and manufacturer.
  • Funds will be released to the marketer upon confirmation of order fulfilment by the buyer/entrepreneur/medicinal practitioner.

6. Payment & Renewal

  • Basic Membership is free of cost except for the proprietary product showcasing fee (₹800/- per product/year).
  • Premium Membership requires a yearly subscription fee (as applicable at the time of joining).
  • All payments must be made through the approved payment modes mentioned on the platform.
  • Fees paid are non-refundable.
  • Renewal reminders will be provided 30 days before expiry.
  • Non-renewal will automatically downgrade membership to Basic.

7. Distribution Port

  • Marker is willing to transport their goods from their stockiest then only one distribution network is allowed, and can add all business details. All the transactions and billing for transport will be considered from that end only.

8. Limitations of Liability

  • 3pmCIRCLE acts as a business facilitation platform and does not guarantee sales or commercial success.
  • We do not endorse or verify the therapeutic claims of listed products.
  • Any business transaction or agreement between a marketer and a buyer is at their own risk.
  • We shall not be liable for disputes arising out of product quality, delivery, payments, or regulatory actions.

9. Termination & Suspension

  • Membership may be terminated or suspended if a member:
    • Violates these T&C.
    • Provides misleading or false product information.
    • Fails to comply with AYUSH/Drug & Cosmetics Act or any applicable regulation.
    • Engages in unfair trade practices.
  • No refund will be issued upon termination of Premium Membership.

10. Amendments

  • We (SUN CONSULTATION/3pmCIRCLE) reserve the right to amend or modify these Terms & Conditions, membership structure, or benefits at any time.
  • Members will be notified via email/portal updates. Continued participation implies acceptance of revised terms.

11. Return & Refund Policy (Damaged / Non-Standard Products)

  • Buyer Rights: If a client (entrepreneur or practitioner) receives products that are damaged, defective, expired, or not meeting agreed standards/quality specifications, the client has the right to request a return and refund through the 3pmCIRCLE platform within 7 business days of delivery.
  • Marketer Obligations:
    • The marketer is responsible for arranging the return pickup (or accepting return delivery).
    • The marketer must either:
      • Replace the returned product with the correct/standard product, OR
      • Refund the full order value (excluding applicable service charges) through the escrow system.
    • The refund or replacement must be initiated within 10 business days of approval.
  • Service Charges:
    • Platform service charges are non-refundable under all circumstances.
    • The marketer bears responsibility for losses arising from product non-compliance, defects, or damages.
    • The marketer shall be liable to pay Platform Service Charges at the rate of 10% of the total order value for bulk orders.
  • Dispute Escalation:
    • If there is disagreement, both parties must submit supporting documents (photographs, invoices, lab reports, if applicable).
    • 3pmCIRCLE will attempt fair mediation. If unresolved, the case will be escalated to arbitration/legal process as per Indian law.

12. Digital Promotion & Branding (Premium Members)

  • Cross-branding and digital promotions will be carried out as per 3pmCIRCLE’s internal campaign strategy.
  • 3pmCIRCLE reserves the right to decide placement, visibility, and format of promotions.

13. Governing Law

  • These Terms & Conditions shall be governed by and construed in accordance with the laws of India.
  • Any disputes shall be subject to the jurisdiction of the courts in Jamnagar, Gujarat.

14. Modification of Terms

  • SUN CONSULTATION reserves the right to amend, update, or discontinue any part of 3pmCIRCLE services and these Terms & Conditions at any time without prior notice.
  • Continued use of the platform constitutes acceptance of such changes.
